Guest Wi-Fi: Terms and Conditions

Guest wireless internet access service ("Service") is provided subject to the following terms and conditions (“Conditions”). The Conditions may be revised at any time. By using the Service, the user agrees to accept unconditionally the Conditions. If you (“User”) do not agree to comply with the Conditions, you must not access or use the Service.

 

Disclaimer of warranties and limitation of liability

1. The Service is provided to each User on an “as-is” basis without expressed or implied warranties or representations of any kind. Rich Union Development Limited (“Company”) does not warrant or guarantee the quality, reliability, security and availability of the Service and accepts no liability whatsoever in relation thereto.
2. In all circumstances, Company shall accept no direct or indirect liability for any kind of loss or damages arising from the failure, interruption, delay or suspension of the Service or the use or attempted use of the Service.  User’s access and use of this Service is at the User’s own risk. Each User acknowledges that:

• Wireless network is in nature “open” and may be susceptible to eavesdropping;
• Unauthorized third parties may access User’s devices or files or otherwise monitor User’s connection;
• User uses the Service to transmit or receive any confidential information or data at the User’s own risk;
• User shall be responsible for keeping his or her devices and personal information confidential so as to make sure such information is not revealed or disclosed to any third party;
• User’s devices may be exposed to viruses or other harmful applications through the Service.

 

Privacy

3. Each User acknowledges that Company will keep logs of all wireless and internet connections. The logs will be used by the Company for service maintenance and support, capacity planning, and property management services.  Any information contained in the logs will not be disclosed to any unauthorised person, unless the disclosure is required by law, regulation or court order, or is necessary for law enforcement or preventing or stopping illegal activities or contravention of the Conditions. Company will not have or accept any liability, obligation or responsibility whatsoever for any loss, destruction, or damage (including without limitation direct or indirect, special or consequential loss, destruction or damage) howsoever arising from or in respect of the disclosure.

 

Unpermitted uses

4. User shall comply with all applicable laws and regulations of the Hong Kong Special Administrative Region (“HKSAR”) when using the Service.
5. User must NOT use the Service for or during the use of the Service:-

• engage in any illegal activity;
• cause inconvenience or annoyance to other persons when using this Service;  
• unauthorisedly upload or download or for any infringement of intellectual property rights of any parties;
• use the Services in a manner that offends the standards of the general community:

• cause Company to breach any law governing its conduct or to incur a liability to any third party;
• interfere with the integrity and/or performance of the Service, Company network or equipment;
• depict, allude to, or promote offensive or illegal behaviour;
• access to websites that may contain obscene, indecent, nudity, violence or offensive subject matter;
• transmit junk mail, chain letters or unsolicited mailing, instant messaging or spamming;
• transmit contents which contain viruses, Trojan horses, worms, time bombs, cancelbots, or other computer programming routines that may damage, interfere or intercept access;
• affect adversely the reputation of Company.

6. Company shall have the absolute right to terminate (or prohibit or disallow any User from using) the Service at any time without prior notice or grounds.

 

Indemnity

7. If any illegal acts are engaged through using the Service, Company may take such actions as it considers appropriate against the User including without limitation referring the case to the relevant bodies or authorities for their investigation or action and stopping the User from using this Service.
8. Each User shall be liable for and fully indemnify and  hold harmless the Company, its affiliates and their respective directors, officers, employees and agents, from and against all claims, actions, proceedings, losses, damages, liabilities, charge, expense (including all reasonable legal and other professional costs on a full indemnity basis) of any nature or kind arising from such User’s use of the Service.
9. The Conditions shall be governed by and construed in accordance with the laws of HKSAR. Each User agrees to submit to the exclusive jurisdiction of the courts of HKSAR.
